4. USER ACCOUNTS AND INFORMATION

5. SMS COMMUNICATION TERMS

5.1 Consent to SMS

By providing your mobile phone number and opting in, you consent to receive SMS text messages from Simply Home regarding real estate services, appointment reminders, market updates, and related communications.

5.2 Types of SMS Messages

You may receive messages regarding:

  • Appointment reminders and confirmations

  • Property and market updates

  • Event invitations and announcements

  • Transaction status updates

  • General real estate communications

5.3 Message Frequency

Message frequency will vary based on your activity and interests. You may receive multiple messages per week during active transactions and fewer messages during other periods.

5.4 Fees and Charges

Simply Home does not charge for SMS messages. However, standard message and data rates may apply from your wireless carrier. Contact your carrier for details.

5.5 Opt-Out

You may opt out of SMS messages at any time by:

After opting out, you will receive one confirmation message and then no further SMS communications unless you opt back in.

6. REAL ESTATE SERVICES

6.1 No Guarantee of Outcome

Engaging Simply Home for real estate services does not guarantee the purchase, sale, or lease of any property. All transactions are subject to market conditions, third-party approvals, and other factors outside our control.

6.2 Documentation

You agree to provide all requested documentation in a timely manner to support your real estate transaction.

6.3 Third-Party Services

Real estate transactions may involve third parties including title companies, lenders, inspectors, and appraisers. Simply Home is not responsible for the actions or services of these third parties.

 

7. PROHIBITED ACTIVITIES

You agree not to:

  • Provide false or misleading information

  • Use our services for illegal purposes

  • Attempt to gain unauthorized access to our systems

  • Interfere with other users’ use of our services

  • Transmit viruses or malicious code

  • Violate any applicable laws or regulations

 

8. INTELLECTUAL PROPERTY

All content on our website, including text, graphics, logos, and software, is the property of Simply Home and is protected by copyright and other intellectual property laws.

 

9. DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE

  • DEFECTS WILL BE CORRECTED

  • OUR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

 

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLY HOME SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES

  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE OUR SERVICES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRIOR TO THE CLAIM.

 

11. INDEMNIFICATION

You agree to indemnify and hold harmless Simply Home and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

 

12. GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.

 

13. DISPUTE RESOLUTION

Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in Utah, except that we may seek injunctive relief in court for intellectual property violations.

 

14. TERMINATION

We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice.

 

15. CHANGES TO TERMS

We may modify these Terms of Service at any time. The updated terms will be posted on our website with the revised date. Your continued use of our services constitutes acceptance of the modified terms.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
